Members are invited to a Financial Crime Update: Corporate Criminal Liability under the ECCTA 2023 webinar being held by Weightmans.

There have been significant changes to the law relating to corporate criminal liability which are now in force, and soon to be made law. This includes the new offence of “Failure to Prevent Fraud” (“FTPF”) introduced by the Economic Crime and Corporate Transparency Act 2023 (“ECCTA”). As of the 1st September 2025, the new offence will make large incorporated bodies and partnerships, across all sectors and industries, criminally liable where an employee, agent, or other associated person commits fraud intending to benefit the organisation, and where the organisation did not have reasonable fraud prevention measures in place.

Organisations that are not fully compliant with the new preventative requirements risk potential prosecution and penalties, including unlimited fines. The new offence applies to those that meet two out of the three following criteria:
  • 250+ staff
  • £36 million annual turnover
  • £18 million held assets
